Many academics and researchers who publish scholarly articles on Plato’s philosophy of education claim that the ultimate educational goal for Plato is simply the acquisition of virtues. While such a claim may not be entirely incorrect, it is nevertheless substantially wanting; for although the acquisition of virtue is no doubt paramount, for Plato it primarily serves as a means to another end. In this paper, I aim to show that, for Plato, the final summit of all educational enterprise is not (...) really to become virtuous but rather to attain the state of becoming like God, and that is, homoiōsis theōi. -/- . Most studies on Nietzsche seldom associate him with the dialectic method. We readily think of Socrates, Hegel, and Marx when we hear of dialectic, but very rarely, if at all, of Nietzsche. To date, very few studies on Nietzsche have claimed that one of the German philosopher's underpinning philosophical methodologies in his literary oeuvre is the dialectic. This paper thus intends to show that Nietzsche has been employing the dialectic throughout his writings, especially in his treatment of the "free spirits"-a (...) recurring subject in his different compositions. To do this, I will first revisit the meaning of dialectic in Socrates, Hegel, and Marx and subsequently argue that in Nietzsche, a type of dialectic akin to Hegel's permeates his writings. In the next parts of this paper, I will discuss in-depth how for Nietzsche, the incarnation of the free spirits involves not just one, but a continuum of triple dialectic. I will argue that to become a free spirit, one must constantly apply the dialectics of (1) criticality and openness, (2) unlearning and relearning, and (3) overcoming and becoming. These dialectics, in my view, are the necessary conditions for any individual to be truly free. In this paper, I will importantly highlight that these dialectics run through Nietzsche's works starting from the early up to the final period of his literary productivity. (shrink)

Using Richard Rorty’s concept of contingency, this paper aims to show that standardized education is problematic; it cannot truly ensure or even accurately measure quality in education. Why Richard Rorty? Why his ideas? Rorty (1931-2007) was an American contemporary philosopher who was heavily influenced by pragmatism – a philosophical approach that is more concerned about the practical consequences of ideas rather than their theoretical elaboration. What I find interesting in Rorty is the fact that his pragmatism – or neo-pragmatism to (...) be precise – holds the key to his philosophy of education. Rorty’s educational philosophy, built upon Dewey’s pragmatic philosophy of education, presents a postmodern vision of education, meaning to say, it does not readily accept and even challenges the status quo; as such, it questions the finality of established standards. Thus, on account of the characteristics that are peculiar to Rorty’s philosophy of education, he has become my logical choice: that is, I hope to attain the aim of this paper by using his neo-pragmatic and postmodern approach to education. Specifically, I will examine the problem of standardized education in the light of Rorty’s concept of contingency. To reach this end, I will first present his concept of contingency. I will next go into his philosophy of education. Then, I will give a general overview of standardized education. Finally, I will expose where the problem of standardized education lies with the aid of Rorty’s concept of contingency and, needless to say, offer Rortyan recommendations, if not outright solutions, to this problem. The Zhuangzi to this day continues to be a hermeneutical challenge in that it always calls for new and fresh interpretations. In the past thirty years, however, various scholars have argued in their studies that the Zhuangzi does not only pose a hermeneutical challenge, but also carries an implicit hermeneutics. My aim in this paper is to show that underneath its parables and rhetoric, fictional and imaginary characters, as well as its inclination towards relativism and skepticism, a Zhuangzian hermeneutics comparable (...) to the hermeneutical theories of Paul Ricoeur and Hans-Georg Gadamer in the West subtly permeates the Zhuangzi. To attain this aim, I will first present and examine the three types of words in the Zhuangzi and do a Ricoeurian reading of these words. I will consequently identify the hermeneutics of skepticism implied in the Zhuangzi and argue that it is a hermeneutical approach that is dominant in the text. I will then contend that in addition to the hermeneutics of skepticism, the Zhuangzi also contains what I call a perspectival hermeneutics with a number of elements that echo Gadamer’s hermeneutical theory. President Rodrigo Duterte to this day has continued to enjoy popularity among majority of the Filipinos. And this, even as Duterte himself has continually graced the headlines, not for any outstanding humanitarian achievement, but for his typical but highly controversial personal blunders and braggadocios, outrageous remarks, and penchant for informalities. And this, too, even as no less than the U.S. intelligence department tags him as a “threat to democracy” and no less than some influential bishops in the Catholic Church accuse (...) him of already going beyond the bounds of the ethical. What could be the reasons why Duterte is still this popular among many Filipinos despite the many controversies that continue to hound him? Does this mean that today’s Filipinos have become too politically blasé to care about what’s going on in the political arena of their country? Or, could it be that Duterte’s continuing popularity actually reflects the political vision of contemporary Filipinos? To answer these questions, in this paper, I will do a Ricoeurian reading of Duterte’s popular presidency. By Ricoeurian reading, I mean that I will be using selected elements in Ricoeur’s political philosophy as evaluative tools in analyzing: 1) whether President Duterte is indeed a “threat to democracy”; 2) whether the Duterte government still falls within the ethical; and 3) whether Duterte’s popular presidency actually reflects the political vision of contemporary Filipinos. In Gaudium et Spes, the Catholic Church describes marital discernment as the married couple’s “common reflection and effort… [that] involves a consideration of their own good and the good of their children” and also as “an estimation of the good of the family… [that necessitates] prudent reflection and common decision.” With this description, we can say that the Catholic Church expects and desires married couples to resolve marital and family conflicts by coming together in discernment. And yet, how should married (...) couples discern? How should they exercise marital discernment? Since one cannot just go on discerning blindly without minding some rules, without following some basic steps, Ricoeur would emphasize that “discernment calls for a hermeneutics.” But how should hermeneutics be integrated into the process of marital discernment? This paper makes an attempt to integrate hermeneutics into the process of marital discernment by drawing some key principles from Paul Ricoeur’s hermeneutic phenomenology and Karol Wojtyła’s phenomenology of spousal love. In so doing, this paper considers how the dynamics of marital discernment can be rendered more balanced, and hence more effective, in attaining conflict resolution within the family. (shrink)

In this paper, I aim to show that the critical appropriation of political power can be a potential tool in transforming political structures into just institutions. To achieve this aim, I will employ Ricoeur's hermeneutics of symbols because in his different political essays, he consistently regards political power as akin to a symbol. Thus, for him, the critical appropriation of political power requires a hermeneutical procedure. And so in my discussion, I will devote one section for Ricoeur's hermeneutics of symbols, (...) one for his thoughts on political power, and another one for the critical appropriation of political power through the hermeneutics of symbols. To put Ricoeur's political and hermeneutical thoughts in a better light, I will introduce these sections with a separate section on his philosophical anthropology. In my conclusion, I will affirm that transforming political structures into just institutions is very much possible through the critical appropriation of political power. It is such a potential tool in effecting these transformations because the critical appropriation of political power involves a hermeneutical procedure that follows a three-step process of reflection. And reflection, which makes way for the critical appropriation of political power, is what ensures that power rests only in the hands of those who are more likely to advance the common good, resulting into a greater possibility for the transformation of political structures into just institutions. One of the intellectual giants in church history who first utilized philosophy to embark on the depths of faith was St. Augustine of Hippo (a.D. 354 - 430). But what had prompted Augustine to approach faith through philosophy? What is his conception of faith? How did he arrive at a deeper and better understanding of faith via philosophy? In this paper, I will explore the saint's philosophy of faith and argue that in Augustine, we can find not just one but (...) three levels of faith, namely: the regula or doctrina fidei, the intelligentsia fidei, and the experiential fidei. And for Augustine, the highest level of faith can only be had not through any intellectual efforts but solely through charity or concrete acts of love. (shrink)

This paper is an attempt to bring together the convergent elements in J.L. Austin’s and Paul Ricoeur’s philosophies of language. Though a number of studies have already claimed that Ricoeur has in some ways been influenced by Austin, to date, not a single study has been made that exclusively focuses on the interrelatedness between Austin’s and Ricoeur’s philosophies of language. Thus, in this paper, I will start with a general exposition of the philosophical connection between Austin and Ricoeur. I will (...) then show how Austin and Ricoeur define and also understand the nature of words, the central component of every language. I will next explore the interplay of meaning and hermeneutics through a detailed discussion of the Speech Acts Theory (Austin) and the Hermeneutics of Symbols (Ricoeur). Afterward, I will argue that in Austin and Ricoeur, words, meaning, and hermeneutics constitute the art of making sense of things and of interpreting certain aspects and features of language. I further explain that what motivates Lubich to engage in different dialogues is the desire to contribute to the fulfillment of Jesus' prayer on the night before he died: "That all (...) may be one.". As rational animals, human beings not only have the ability to think but also the capacity to understand. Human rationality, so to speak, is constituted by thinking and understanding. The immediate connotation of rationality, however, is almost always thinking. Hence to speak of man as an animal rationale is to speak of man as a thinking being. But following his mentor Martin Heidegger, Hans-Georg Gadamer insists that man does not only think, but most importantly understands. To understand is an essential (...) part of being human, of being rational. But what is understanding? What does it mean to understand? The issue of human understanding is not something simply epistemological; rather, it is something hermeneutical. That is to say, understanding always relates to the act of interpretation. In his monumental work Truth and Method, Gadamer diligently considers the matter of human understanding from a purely hermeneutical perspective. This paper, then, aims to synthesize Gadamer's hermeneutical theory and argues that for Gadamer, human understanding is essentially characterized by a kind of textual intercourse, that is, a dialogic interaction or an intimate exchange of horizons between an interpreting subject and a text which, in very broad terms, can refer to any object of interpretation. The Catholic Church never officially endorses political candidates but rather respects the freedom of its faithful to vote according to the dictates of their conscience. However, in the last presidential elections, some Catholic bishops and priests in the Philippines publicly and openly supported the presidential candidacy of Vice President Leni Robredo while urging the rest of the faithful to do the same. These bishops and priests anchored their position on their shared belief that voting for Robredo was the only rightful (...) and moral option because of her clean track record, non-involvement in any act of corruption, and principled approach in governance. In contrast, her political archnemesis Ferdinand “Bongbong” Marcos, Jr. had long been embroiled in several allegations of corruption, non-payment of taxes, and fakery of educational attainments. Hence, for these bishops and priests, voting for Marcos Jr. was both wrong and immoral. And yet, the election results hit them with a big “slap in the face,” as more than 31 million Filipinos (majority of whom are Catholics) cast their votes for Marcos Jr., while only 15 million voted for Robredo. This outcome, no doubt, raises the question: Why did the repeated calls of these bishops and priests go unheeded? In this paper, I will attempt to answer this question by subjecting the political moralism of these Catholic leaders to some objective postmodern evaluation. To do this, I will employ the postmodern thoughts of Nietzsche, Lyotard, and Rorty as a lens to examine why many Filipino Catholics today no longer buy the political moralism of their religious leaders. Since Ricoeur has largely been identified with hermeneutics, he is very seldom associated with critical theory – a regrettable case since his hermeneutics actually holds the access to his critical theory. Must the best friends necessarily be good people? On the one hand, as Aristotle puts it, ‘people think that the same people are good and also friends’. But on the other hand, friendship sometimes seems to require that one behave badly. For example, a normally honest person might lie to corroborate a friend's story. What I will call closeness, which I take to include sensitivity to friends' subjective values and concerns as well as an inclination to take their subjective interests (...) as reasons for action, is characteristic of friendship. But this seems to require that good friends should be morally flexible, more so than is compatible with a virtuous character. This would imply tension between ideals of friendship and ideals of character. But there is an important connection between virtue and friendship which arises precisely from friends' closeness, when concern for wellbeing, another important feature of friendship, is also taken into account. This helps mitigate the tension and shows how friendship and virtue are interconnected. The connection in turn provides friendship-based reason to think the best friends must be good people, even though concerns of friendship may occasionally clash with other moral concerns. (shrink)

I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

Proprioception, a sense of bodily position and movement, is rarely the focus of conscious experience. If we are ordinarily conscious of proprioception, we seem only peripherally so. Thus, evidence that proprioception is present in the periphery of at least some conscious experiences seems to be good evidence that conscious experience is fairly rich. Anosognosia for paralysis is a denial of paralysis of one's limbs, usually in the wake of brain damage from stroke. Because anosognosic patients overlook their paralysis, anosognosia seems (...) be a counter-example to the claim that proprioception exists in the periphery of conscious experience. However, careful consideration of the data shows that anosognosia makes a poor counterexample to a rich theory of consciousness. Thus, we retain reason to believe that proprioception exists in the periphery of conscious experience, and so to conclude that conscious experience is relatively rich. (shrink)

The status and functioning of shame is contested in moral psychology. In much of anglophone philosophy and psychology, it is presumed to be largely destructive, while in Confucian philosophy and many East Asian communities, it is positively associated with moral development. Recent work in human-robot interaction offers a unique opportunity to investigate how shame functions while controlling for confounding variables of interpersonal interaction. One research program suggests a Confucian strategy for using robots to rebuke participants, but results from experiments with (...) educational technologies imply a different and potentially opposing account of shame’s role in personal development. By digging deeper into the details of Confucian theorizing about shame, I identify a unifying explanation for these apparently conflicting results. I conclude by offering suggestions for future empirical research in human-robot interactions to further investigate shame’s role in moral development. (shrink)

When it comes to social robotics (robots that engage human social responses via “eyes” and other facial features, voice-based natural-language interactions, and even evocative movements), ethicists, particularly in European and North American traditions, are divided over whether and why they might be morally considerable. Some argue that moral considerability is based on internal psychological states like consciousness and sentience, and debate about thresholds of such features sufficient for ethical consideration, a move sometimes criticized for being overly dualistic in its framing (...) of mind versus body. Others, meanwhile, focus on the effects of these robots on human beings, arguing that psychological impact alone can qualify an entity for moral status. What both sides overlook is the importance for ordinary moral reasoning of integrating questions about an entity’s “inner life,” and its psychological effect on us. Turning to accounts of relationships in virtue ethics, especially those of the Confucian tradition, we find a more nuanced theory that can provide complex guidance on the moral considerability of social robots, including ethical considerations about whether and how to question this to begin with. Albert Camus, a French-Algerian writer and philosopher, is renowned for his unique contribution to the philosophical realm, particularly through his exploration of the Absurd. His philosophy is often associated with existentialism, despite his own rejection of the label. Camus’ works delve into the human condition and the search for meaning in a seemingly indifferent universe. The Absurd and the Search for Meaning At the heart of Camus’ philosophy is the concept of the Absurd, which arises from the conflict between the (...) human desire for significance, order, and clarity on one hand, and the silent, irrational, and indifferent world on the other1. This tension is a fundamental aspect of the human experience, as individuals continually seek purpose in life despite the universe’s lack of inherent meaning. Revolt as a Response to the Absurd Camus argues that the appropriate response to the Absurd is not suicide or despair, but rather revolt. This revolt is a persistent and courageous confrontation with the Absurd, and it involves a refusal to succumb to nihilism, a rejection of false hopes, and the continuous quest for meaning1. It is through this act of revolt that individuals affirm their own existence and derive a sense of personal freedom and identity. Camus’ Literary Expression of Philosophy Camus’ philosophical ideas are intricately woven into his literary works. Novels such as “The Stranger” (L’Étranger), “The Plague” (La Peste), and “The Fall” (La Chute) not only tell compelling stories but also serve as vehicles for his philosophical thought. In “The Myth of Sisyphus,” Camus uses the Greek mythological figure Sisyphus, condemned to eternally roll a boulder up a hill only for it to roll back down, as a metaphor for the human condition. In modern philosophy of nature the World is unified and holistic. Cosmic Universe and Human History, microcosm and macrocosm, inorganic and living matter coexist and form a unique unity manifested in multiple forms. The Physical and the Mental constitute the form and the content of the World. The world does not consist of subjects and objects, the “subject” and the “object” are metaphysical abstractions of the single and indivisible Wholeness. Man’s finite knowledge separates the Whole into parts and studies fragmentarily (...) the beings. The Wholeness is manifested in multiple forms and each form encapsulates the Wholeness. The rational explanation of the excerpts and the intuitive apprehension of the Wholeness are required to combine and create the open thought and the holistic knowledge. This means that the measurement should be defined by the ''measure'', but the responsibility for determining the ''measure'' depends on the man. This requires that man overcomes the anthropocentric arrogance and the narcissistic selfishness and he joins the Cosmic World in a friendly and creative manner. (shrink)

In modern philosophy of nature the World is unified and holistic. Cosmic Universe and Human History, microcosm and macrocosm, inorganic and living matter coexist and form a unique unity manifested in multiple forms. The Physical and the Mental constitute the form and the content of the World. The world does not consist of subjects and objects, the “subject” and the “object” are metaphysical abstractions of the single and indivisible Wholeness. Man’s finite knowledge separates the Whole into parts and studies fragmentarily (...) the beings. The Wholeness is manifested in multiple forms and each form encapsulates the Wholeness. The rational explanation of the excerpts and the intuitive apprehension of the Wholeness are required to combine and create the open thought and the holistic knowledge. This means that the measurement should be defined by the ''measure'', but the responsibility for determining the ''measure'' depends on the man. This requires that man overcomes the anthropocentric arrogance and the narcissistic selfishness and he joins the Cosmic World in a friendly and creative manner. (shrink)

In the Critique of the Power of Judgment, Immanuel Kant characterizes the sublime as a negative pleasure derived from the encounter with something absolutely great. Some scholars have claimed that Kant’s notion of the sublime only applies to objects in nature (Abaci 2008, 239). Others contend that the object that provokes the sublime experience is not confined to objects of nature since the sublime is an experience in the mind (Clewis 2010, 169). This paper argues that Kant’s Critique and the (...) Grateful Dead’s song “The Other One” provide a framework for understanding the artistic mathematical sublime in music, wherein the pleasure and displeasure experienced when engaging with music can be identified as instances of the sublime. Beginning with an elucidation of Kant’s concepts of judgments of taste and the sublime, the paper explores their similarities and differences. Notably, his theory of the sublime is less developed than his theory of the beautiful. This provides an opportunity to interrogate arguments surrounding which objects can elicit the sublime and how artworks represent or present it to their viewers. After demonstrating a textual disparity of the role of music in Kant’s Critique, I show how music without words, also known as jams, can fit the definition of free beauty and can be classified as art. The discussion further delineates the process of experiencing the mathematical sublime and describes indicators in music theory for discerning the sublime in musical compositions. I use the Grateful Dead’s performance of “The Other One” on April 7, 1972, to illustrate how particular works of art manifest the mathematical sublime. The paper concludes by reflecting on how the qualitative description of the piece highlights why “The Other One” should be seen as both artistic (because, while the piece is coherent, there is no discernible concept that seems to unify it) and sublime (because it is mind-blowingly complex). How we engage with music like the Grateful Dead can allow us to discuss why particular works of art are meaningful to us. (shrink)

This study aims to generate thorough and comprehensive review of the teacher’s perspective and hands-on experience in mainstreaming LSENs in a regular classroom, including teachers’ attitudes and perceptions, challenges encountered, and teaching approach in handling mainstreamed classrooms. A scoping review framework by Arksey and O’Malley’s (2005) systematically analyzed the data of the different articles conducted by various scholars. Through scrupulous and through selection of related studies, 10 articles were included in the review from 6 different countries across the globe. The (...) articles included were conducted from 6 countries and various databases. The study highlighted that: 1) teachers have positive and negative attitudes towards mainstreaming, 2) teachers experienced various challenges in handling a mainstream classroom, and 3) learner-centered approach to learning is used in the classroom. Mainstreaming LSENs in a regular classroom has pros and cons among teachers, regular students, and the LSENs themselves. Hence, a daunting responsibility for the teachers. Nevertheless, it is imperative to support teachers by giving seminars and training, especially to those non-special education majors, to be fully equipped to handle mainstreamed classrooms. (shrink)

We advocate and develop a states-based semantics for both nominal and adjectival confidence reports, as in "Ann is confident/has confidence that it's raining", and their comparatives "Ann is more confident/has more confidence that it's raining than that it's snowing". Other examples of adjectives that can report confidence include "sure" and "certain". Our account adapts Wellwood's account of adjectival comparatives in which the adjectives denote properties of states, and measure functions are introduced compositionally. We further explore the prospects of applying these (...) tools to the semantics of probability operators. We emphasize three desirable and novel features of our semantics: (i) probability claims only exploit qualitative resources unless there is explicit compositional pressure for quantitative resources; (ii) the semantics applies to both probabilistic adjectives (e.g., "likely") and probabilistic nouns (e.g., "probability"); (iii) the semantics can be combined with an account of belief reports that allows thinkers to have incoherent probabilistic beliefs (e.g. thinking that A & B is more likely than A) even while validating the relevant purely probabilistic claims (e.g. validating the claim that A & B is never more likely than A). Finally, we explore the interaction between confidence-reporting discourse (e.g., "I am confident that...") and belief-reports about probabilistic discourse (e.g.,"I think it's likely that.."). Is consistency the sort of thing that could provide a guide to mathematical ontology? If so, which notion of consistency suits this purpose? Mark Balaguer holds such a view in the context of platonism, the view that mathematical objects are non-causal, non-spatiotemporal, and non-mental. For the purposes of this paper, we will examine several notions of consistency with respect to how they can provide a platon-ist epistemology of mathematics. Only a Gödelian notion, we suggest, can provide a satisfactory guide to (...) a platonist ontology. Is consistency the sort of thing that could provide a guide to mathematical ontology? If so, which notion of consistency suits this purpose? Mark Bala-guer holds such a view in the context of platonism, the view that mathematical objects are non-causal, non-spatiotemporal, and non-mental. Balaguer's version of Platonism, Full-Blooded Platonism (FBP), is the view that "there are as many abstract mathematical objects as there could be-i.e., there actually exist abstract mathematical objects of all possible kinds" (Balaguer, 2017, p. 381). He continues: Since FBP says that there are abstract mathematical objects of all possible kinds, it follows that if FBP is true, then every purely mathematical theory that could be true-i.e., that is internally consistent-accurately describes some collection of actually existing abstract objects. Thus it follows from FBP that in order to acquire knowledge of abstract objects, all we have to do is come up with an internally consistent purely mathematical theory (and know that it is internally consistent). This essay re-reads François Hemsterhuis's philosophical dialogue Alexis (1787) as a post-Copernican cosmic theodicy that prefigures a central nexus of concerns in Early German Romanticism. This theodicy is cross-scalar, in that it functions across three disparate scales: the history of global humanity, the geo-cosmic history of the Earth, and the broader processuality of the universe. From the perspective of this cross-scalar entanglement, I reconstruct Hemsterhuis's vision of the ages of the world and his theodical narrative of the golden age, (...) the Fall, and the cosmic destiny of humanity. Additionally, I offer a counter-reading of this destiny through the story of the Moon in Alexis, and through the contingency, uselessness, and cosmic failure that the Moon embodies. (shrink)

Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary connection (...) between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

In this article, I raise three potential objections to Alexis Shotwell’s view of “implicit knowledge,” which she presents in her book Knowing Otherwise.

Digital records, from chat transcripts to social media posts, are being used to create chatbots that recreate the conversational style of deceased individuals. Some maintain that this is merely a new form of digital memorial, while others argue that they pose a variety of moral hazards. To resolve this, I turn to classical Chinese philosophy to make use of a debate over the ethics of funerals and mourning. This ancient argument includes much of interest for the contemporary issue at hand, (...) including the use of impersonators of the dead to help the bereaved to deal well with their grief. I connect this historical discussion with a modern trend in clinical psychology that reframes therapeutic interventions with bereaved individuals. The trend directs practitioners away from facilitating detachment and toward affirming continuing bonds. I conclude that these chatbots can offer an important source of support to mourners, but also discuss parameters and features of social context that will be important to avoid the moral hazards identified by sceptics. Zhuangzi suggests that death is a transformation that we commonly and mistakenly think means the end of someone but really just marks a new phase of existence. This metaphysical thesis is presented at several points in the text as an explanation of distinctively Daoist responses to death and loss. Some take a Daoist response to death, as presented by Zhuangzi, to indicate dual perspectives on friendship and death. But I argue that the metaphysical view sketched above is consistent with a (...) unified perspective, allowing the Daoist to enjoy deep friendships without risking some potential for grief typically associated with strong attachment. However, it leaves the Daoist best suited to friendships with those who endorse the same metaphysics. Furthermore, while the grief associated with the death of a friend is somewhat mitigated, the Daoist has reason to mourn even given this thesis. (shrink)

Η μοντέρνα φιλοσοφία στράφηκε απευθείας στη φύση (Francis Bacon), στράφηκε απευθείας στο νου (René Descartes), στράφηκε απευθείας στην εμπειρία (Thomas Hobbes). Από αυτή τη βασική διαφωνία ως προς τις πηγές της φιλοσοφικής γνώσης προέκυψε η «διαμάχη των αρχαίων με τους σύγχρονους». -/- Η σύγχρονη φιλοσοφία αποστασιοποιήθηκε από το παγιωμένο γνωσιολογικό παρελθόν και ενστερνίστηκε την αρχή ότι η γνώση προοδεύει ιστορικά και κατατείνει στη διεύρυνση της ανθρώπινης κατανόησης μέσω της λογικής μεθόδου ή μέσω της εμπειρίας. Στη διαμάχη μεταξύ των ηπειρωτικών ορθολογιστών (...) φιλοσόφων (Descartes, Nicolas Malebranche, Gottfried Wilhelm Leibniz και Benedict de Spinoza) και των Βρετανών εμπειριστών (Hobbes, John Locke και David Hume) στο τέλος του Διαφωτισμού του δέκατου όγδοου αιώνα, ο Immanuel Kant επιχείρησε να συμφιλιώσει τις αντιθέσεις και να διατυπώσει μια νέα κριτική φιλοσοφία. Αυτό το «διπλό», όπως το ονόμασε ο Michel Foucault, αντιπροσώπευε έναν εντελώς νέο τρόπο φιλοσοφίας. Ως εκ τούτου, στον μοντερνισμό, την ίδια στιγμή που ορισμένες θεωρίες βασίζονταν στη γνώση σε μια επικεντρωμένη, υπερβατική, ερμηνευτική υποκειμενικότητα και άλλες βασίζονταν στη γνώση σε βέβαιη, ατομικιστική, αναλυτική, εμπειρική αντικειμενικότητα, η κρίση στη γνώση δημιούργησε μια αίσθηση αβεβαιότητας, παραδοξότητας, ατέλειας, ανεπάρκειας, κενό. Οι ριζοσπαστικοί ισχυρισμοί του λογικού θετικισμού απέκλειαν ό,τι είχε αξία: τη μεταφυσική, την αισθητική, την αξιολογία. Η αυστηρή επιστήμη της υπερβατικής φαινομενολογίας απέκλεισε την ίδια την ύπαρξη αυτού που ερευνούσε. Ο δυϊσμός του δημιουργικού εξελικτισμού άφησε μια ανεπανόρθωτη διχοτόμηση μεταξύ βιωμένης εμπειρίας και αντικειμενικής γνώσης. Ο πραγματισμός του ριζοσπαστικού εμπειρισμού απέτυχε να προσφέρει έναν τρόπο ερμηνείας των νοημάτων της εμπειρίας. Το κέντρο του μοντερνισμού στη φιλοσοφία δεν μπορούσε να κρατήσει γιατί τα ίδια τα θεμέλιά του ήταν υπό αμφισβήτηση. Αλλά οι προσπάθειες να το ανακτήσει κανείς από τον εαυτό του με τη στροφή προς τη γλώσσα - καθημερινή γλώσσα, αναλυτικές φιλοσοφίες της γλώσσας, ερμηνευτική της γλώσσας, σημειολογίες της γλώσσαςδεν μπόρεσαν να λύσουν τα διλήμματα της ανθρώπινης ύπαρξης. Ο μοντερνισμός στη φιλοσοφία αντιμετώπισε το παράλογο, το διφορούμενο και το διαλεκτικό και εξώθησε αυτές τις θεωρίες στα όριά τους. Στα μέσα της δεκαετίας του 1960, η φιλοσοφία άρχισε να εξετάζει τους γνωσιολογικούς της, οι ανακρίσεις του Maurice Merleau-Ponty αναδιατυπώθηκαν στην αρχαιολογία της γνώσης του Foucault. Στις αρχές της δεκαετίας του 1970, ο μεταμοντερνισμός - ένας όρος που χρησιμοποίησε ο Daniel Bell σε σχέση με τη μεταβιομηχανική κοινωνία τη δεκαετία του 1950, τον οποίο έκαναν έκκληση οι αρχιτέκτονες στη δεκαετία του 1960 και που οι ιστορικοί της τέχνης και της λογοτεχνίας επικαλέστηκαν τη δεκαετία του 1970 - δεν είχε ακόμη επικαλεστεί σε σχέση με τη φιλοσοφία. -/- Η γραμματολογία και η θεωρία της «διαφοράς» του Ζακ Ντεριντά το 1967 (με βάση την αφήγηση του Μάρτιν Χάιντεγκερ για το «τέλος της φιλοσοφίας και το έργο της σκέψης») μετατράπηκαν σε πλήρη αποδόμηση τη δεκαετία του 1970. Η έννοια του Gilles Deleuze και του Felix Guattari για τη ριζωματική σκέψη (σε αντίθεση με την ιεραρχική, εξουσιοδοτημένη δενδρώδη σκέψη) σηματοδότησε μια κίνηση ενάντια στις ψυχαναλυτικές θεωρίες που βασίζονται στην Οιδιπόδεια αυθεντία και την πατρική επιμονή. Η ιδέα τους για τον νομαδισμό έδωσε έμφαση στη γνώση, την εμπειρία και τις σχέσεις που δεν ήταν οργανωμένες γύρω από μια κεντρική έννοια. Η αφήγηση του J. Kristeva για την επανάσταση στην ποιητική γλώσσα σηματοδότησε τη διάκριση μεταξύ του σημειωτικού και του συμβολικού. Όπου η συμβολική —επιστημονική, θεωρητική, φαλλική, πατρική— σκέψη είχε διαποτίσει τη φιλοσοφία και την επιστήμη, η Kristeva επικαλέστηκε τη σημειωτική ως την ποιητική, ρευστή, σαν υποδοχέα, μητρική σκέψη που έχει κρυφτεί στη σύγχρονη σκέψη. Ωστόσο, το μεταμοντέρνο δεν ήταν σχεδόν ο όρος που χρησιμοποιήθηκε για να περιγράψει αυτό το είδος φιλοσοφίας. Αντίστοιχα, η πιο περιορισμένη μελέτη της φαινομενολογίας και του υπαρξισμού στη φιλοσοφία έδωσε τη θέση της στις πιο πολλαπλές και ποικιλόμορφες θεωρίες που υπονοούνται στην ηπειρωτική φιλοσοφία: αποδόμηση, αρχαιολογία της γνώσης, σημασιολογική ανάλυση, σχιζανάλυση, φεμινιστική θεωρία κ.λπ. Ωστόσο, ενώ ο μεταστρουκτουραλισμός (σε σχέση με τους Foucault, Derrida, Deleuze, Kristeva, et al.) χαιρετίστηκε ως ο διάδοχος του στρουκτουραλισμού (Claude Lévi-Strauss, Roland Barthes, Jacques Lacan, Louis Althusser) και της υπαρξιακής φαινομενολογίας (Heidegger, Jean -Paul Sartre, Merleau-Ponty, Simone de Beauvoir), ο μεταμοντερνισμός δεν ήταν ακόμα μια σχετική κατηγορία στη φιλοσοφία μέχρι και τη δεκαετία του 1980. Despite the initial promise of social media platforms as a means of facilitating discourse on matters of civic discourse, in practice it has turned out to impair fruitful conversation on civic issues by a number of means. From self-isolation into echo chambers, to algorithmically supported filter bubbles, to widespread failure to engage politically owing to psychological phenomena like the ‘spiral of silence’, a variety of factors have been blamed. I argue that extant accounts overlook the importance of interpersonal relationships to (...) sustaining quality civic discourse on social media. Drawing on an Aristotelian account of friendship with an emphasis on the value of interpersonal difference plus the influence of interactions on individual character, I argue that a common scapegoat for the failure of civic discourse online—the variety of “unfriend” disconnection tools offered on various platforms—actually show promise at promoting better-quality civic conversation and overcoming the obstacles present on social media platforms. Feminized AIs designed for in-home verbal assistance are often subjected to gendered verbal abuse by their users. I survey a variety of features contributing to this phenomenon—from financial incentives for businesses to build products likely to provoke gendered abuse, to the impact of such behavior on household members—and identify a potential worry for attempts to criticize the phenomenon; while critics may be tempted to argue that engaging in gendered abuse of AI increases the chances that one will direct this abuse (...) toward human beings, the recent history of attempts to connect video game violence to real-world aggression suggests that things may not be so simple. I turn to Confucian discussions of the role of ritualized social interactions both to better understand the roots of the problem and to investigate potential strategies for improvement, given a complex interplay between designers and device users. I argue that designers must grapple with the entrenched sexism in our society, at the expense of “smooth” and “seamless” user interfaces, in order to intentionally disrupt entrenched but harmful patterns of interaction, but that doing so is both consistent with and recommended by Confucian accounts of social rituals. There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. Caregiving robots are often lauded for their potential to assist with geriatric care. While seniors can be wise and mature, possessing valuable life experience, they can also present a variety of ethical challenges, from prevalence of racism and sexism, to troubled relationships, histories of abusive behavior, and aggression, mood swings and impulsive behavior associated with cognitive decline. I draw on Confucian ethics, especially the concept of filial piety, to address these issues. Confucian scholars have developed a rich set of theoretical (...) resources for dealing with beloved but imperfect elders, and navigating the challenges of supporting seniors whose ethical commitments are unreliable. These resources provide a way to reconcile two important but conflicting desiderata: to value and care for seniors, but also to clear-mindedly deal with their moral shortcomings. In particular, they articulate a duty to remonstrate with our elders when they err. Confucian filial piety can helpfully inform robot design and use in geriatric care. They can be used to strengthen and protect emotional connections in important relationships, but should not be used to reinforce patient preferences when doing so damages relationships or their ability to act morally. Rather than conceive of patient wellbeing as in tension with moral behavior, and care as a burden for caregivers, not a source of value and meaning, Confucian accounts of filial piety help identify both new areas of concern and new potential in the development of caregiving technologies, ones which see these goods as complementary. Δύο επίμονα θέματα ζωντανεύουν όλη τη γραφή του Αλμπέρ Καμύ και αποτελούν τη βάση του καλλιτεχνικού του οράματος: Το ένα είναι το αίνιγμα του σύμπαντος, το οποίο είναι εκπληκτικά όμορφο αλλά αδιάφορο για τη ζωή. Το άλλο είναι το αίνιγμα του ανθρώπου, του οποίου η λαχτάρα για ευτυχία και νόημα στη ζωή παραμένει άσβεστη από την πλήρη επίγνωση της δικής του θνητότητας και της κυρίαρχης αδιαφορίας του περιβάλλοντός του. Στη ρίζα κάθε μυθιστορήματος, κάθε θεατρικού έργου, κάθε δοκιμίου, ακόμη και κάθε (...) καταχώρησης στα τετράδιά του βρίσκεται η αδιάκοπη ανάγκη του Καμύ να διερευνήσει και να προβληματιστεί για τον ειρωνικό διπλό δεσμό που αντιλαμβανόταν ότι ήταν η ουσία της ανθρώπινης κατάστασης: Ο άνθρωπος είναι προικισμένος με τη φαντασία να συλλάβει μια ιδανική ύπαρξη, αλλά ούτε οι συνθήκες, ούτε οι δικές του δυνάμεις επιτρέπουν την επίτευξή της. Η αντίληψη αυτού του απελπιστικού διπλού δεσμού έκανε αναπόφευκτη στον Καμύ την υποχρέωση να αντιμετωπίσει ένα κυρίαρχο ηθικό ζήτημα για τον άνθρωπο: Δεδομένης της περιορισμένης κατάστασης του ανθρώπου, υπάρχουν έντιμοι όροι με τους οποίους μπορεί να ζήσει τη ζωή του;. Μόνο η πεπερασμένη γνώση του ανθρώπου κατακερματίζει σε αντικείμενα το Όλον – στο οποίο και ο ίδιος ανήκει – προκειμένου να κατατοπιστεί» -/- C.F.Von Weizsacker -/- Για την κβαντική θεωρία ο Κόσμος είναι ενιαίος και αδιαίρετος, όλα τα στοιχεία που τον συγκροτούν βρίσκονται σε σχέση αλληλεξάρτησης και αλληλοδιασύνδεσης. Η διασύνδεση των πάντων είναι ιδιαίτερα εμφανής στις μη-τοπικές αλληλεπιδράσεις του κβαντικού κόσμου. Το φαινόμενο (...) της κβαντικής συζευξιμότητας, το οποίο μπορεί να θεωρηθεί μια αρχή υπέρθεσης, καθώς και η απορρέουσα έννοια της κβαντομηχανικής μη διαχωρισιμότητας, ως εγγενές στοιχείο της κβαντικής θεωρίας, συνεπάγεται ότι η αδιαίρετη ενότητα του Όλου συνιστά θεμελιώδες γνώρισμα του κβαντικού κόσμου, όμως ούτε η θεωρία ούτε το πείραμα είναι δυνατόν να προσπελάσουν και να αποκαλύψουν τη δομή ή την υφή της Ολότητας. Στην κβαντομηχανική καλώς ορισμένο αντικείμενο δημιουργείται μέσω μιας τομής Heisenberg, δηλαδή μέσω μιας διαδικασίας αφαίρεσης και προβολής της μη Μπούλειαν Ολιστικής περιοχής σε ένα Μπούλειαν πλαίσιο, το οποίο καθιστά αναγκαία την αποκοπή των κβαντικών συζευγμένων συσχετίσεων από το περιβάλλον του για να αποκτηθεί πρόσβαση στην εμπειρική πραγματικότητα και να συντελεσθεί η περιγραφή της μέτρησης. Δηλαδή η επίτευξη αιτιοκρατικών χωροχρονικών συσχετίσεων, η δυνατότητα χρονικών διασυνδέσεων μεταξύ πρότερου και ύστερου, αιτίας και αποτελέσματος και κατ΄ επέκταση η περιγραφή κάθε διυποκειμενικής εμπειρίας, προϋποθέτουν την διάκριση του Όλου σε γνωρίζον ‘’υποκείμενο’’ και ‘’αντικείμενο’’ προς εξέταση, σε παρατηρητή και παρατηρούμενο. Η κβαντική μηχανική αναγνωρίζει ότι ο παρατηρητής είναι καθεστωτικός παράγοντας στη συγκρότηση του παρατηρούμενου, οι παρατηρητές αρχίζουν σιγά-σιγά να αναγνωρίζουν πλέον τον προθεσιακό (intentional) χαρακτήρα απο τον οποίο διαποτίζεται η γνωσιοθεωρητική πρακτική. Οι παρατηρητές αποκτούν συνείδηση των δημιουργικών δυνατοτήτων τους και συνεπώς του κατασκευαστικού χαρακτήρα των πολλαπλών κόσμων τους, Σ΄αυτό το σημείο θα προβούμε σε αφαιρετικότερους στοχασμούς όσον αφορά την οντολογική φύση της κβαντικής θεωρίας. Η διάκριση του Όλου σε υποκείμενο και αντικείμενο εισάγει τις χωροχρονικές σχέσεις, την αιτιότητα, παράγει τον Λόγο, τη διάκριση θεωρίας και πράξης και εν τέλει το τεχνικο-επιστημονικό πνεύμα που υπολογίζει, μετρά, ποσοτικοποιεί τα μεγέθη και τα χειραγωγεί κατά βούληση. Όλα όσα παράγονται από τη διάκριση του Κόσμου σε Υποκείμενο και Αντικείμενο παράγουν την ανθρωποκεντρική θεώρηση-παράσταση του Κόσμου, τη μυθολογική διαμόρφωση της συνείδησης, τη φαινομενολογική ύπαρξη, την ύπαρξη τινός. Ο Κόσμος που αντιλαμβάνονται οι άνθρωποι συνιστά ένα απόσπασμα του Κόσμου, το Όλον διασπάται σε πολλαπλές προοπτικές (διαφορές φάσης της συνειδησιακής βίωσης του Χρόνου, δηλαδή διαφορές επίπεδων αντίληψης, συνείδησης και ψυχονοοτροπίας) που τον θεωρούν μέσω των εκάστοτε προοπτικών κάθε φορά και τις οποίες αναγορεύουν σε καθολικές προτάσεις και ύπατες αλήθειες ενώ δεν αποτελούν παρά πεπερασμένες διερευνήσεις του απεριόριστου Κόσμου, σχετικές προσεγγίσεις του Απόλυτου………. El presente artículo analiza la etapa denominada arqueológica de Michel Foucault. Puntualizando principalmente cómo en esta etapa es entendido el concepto de libertad desde la noción foucaultiana de discurso. Se aborda, en este sentido, la etapa arqueológica de Foucault desde tres áreas. La primera, nos habla de cómo se erige lo diferente, lo anormal. La segunda, expone cómo se construye lo aparente, lo indiscutible. Por último, a partir de un marco teórico previamente expuesto, reflexionamos respecto del concepto de libertad.
